Marinello has joined Baldwin, Kagan &amp; Gormley, LLC as an Associate.  Mr. Marinello is an experienced litigator, at both the trial and appellate levels, and has significant experience as a general counsel as well.  He practices in the areas of business and employment litigation and other complex general civil litigation.  Mr. Marinello also handles other business and employment issues, government contracts, criminal defense (civilian and military), and military/veterans matters.</p>
<p>Prior to joining Baldwin, Kagan &amp; Gormley, LLC, Mr. Marinello served thirteen years on active duty in the United States Navy, most recently with the Judge Advocate General’s (JAG) Corps for nearly seven years.  As a judge advocate, Mr. Marinello gained extensive criminal and civil litigation experience.  Mr. Marinello also served as a Special Assistant U.S. Attorney in the District of Maryland and Eastern District of Virginia, during which time he prosecuted federal offenses committed on or near various naval bases.  As a civil litigation attorney with the Navy’s General Litigation Division, Mr. Marinello represented and defended the Department of the Navy and its officials in a wide range of civil litigation matters, including wrongful discharge claims, military pay claims, disability and discrimination suits, constitutional torts, <em>Bivens</em> actions, and Freedom of Information Act and Privacy Act matters.  He worked side-by-side with Department of Justice attorneys and Assistant U.S. Attorneys to represent the interests of the Navy and the Department of Defense in U.S. District Courts and U.S. Courts of Appeals throughout the country, as well as the Court of Federal Claims and Court of Appeals for the Federal Circuit. </p>
<p>During his time as a judge advocate, Mr. Marinello also gained significant experience counseling clients.  He served as Deputy General Counsel to the Admiral responsible for the Navy’s Mid-Atlantic Region (covering all naval bases from Virginia to Maine) and General Counsel to the commanding officer of Naval Station Norfolk, the Navy’s largest naval base.  Most recently, Mr. Marinello served for two years as General Counsel to the Commandant of Midshipmen at the U.S. Naval Academy, where he advised the Commandant and his staff on various complex matters, including criminal investigations and courts-martial, Midshipmen discipline and discharge proceedings, civil litigation matters, government ethics, Congressional inquiries, public relations, and claims against the government.</p>
<p>Prior to becoming an attorney, Mr. Marinello served on active duty in the Navy as a Surface Warfare Officer in various positions onboard two warships in San Diego, California.</p>
<p>Mr. Marinello obtained his undergraduate degree and graduated, <em>with merit</em>, from the U.S. Naval Academy.  He earned his Juris Doctor, <em>cum laude</em>, from the University of Maryland School of Law, and he earned a Master of Laws degree in Litigation and Dispute Resolution from The George Washington University Law School, graduating <em>With Highest Honors</em>.  He is admitted to practice in Maryland and the District of Columbia, as well as the United States District Court for the District of Maryland, the United States District Court for the District of Columbia, and the United States Court of Appeals for the Fourth Circuit.</p>
<p>Mr. Marinello and his family are residents of Annapolis, where they are actively involved in local school functions, athletic organizations, and other community events.  Mr. Marinello is a member of the American Bar Association, the Maryland State Bar Association, the Anne Arundel County Bar Association, and the Judge Advocates Association.  He also serves as a Board Member for the Annapolis Chapter of the Naval Academy Alumni Association.</p>

<p>The company in question is an industry leading distribution and service company specializing in marine, homeland security, and safety products for military, law enforcement, fire rescue, emergency management, hospitals, port authorities, and mass transit clients. KLH Capital partnered with the company’s management to provide a liquidity event for shareholders and establish a capital structure to support future growth initiatives. This transaction was the first platform investment within Fund II, our recently closed $91 million SBIC fund.</p>
<p>KLH’s mission is to provide entrepreneurs with capital to facilitate recapitalizations, management buyouts and buy-ins, family successions, and other ownership transitions. To this end, it’s Principals have invested in more than 130 small businesses over the last 30 years.</p>

			<content:encoded><![CDATA[<p align="LEFT">In an <a href="http://www.bkglawfirm.com/2012/07/circuit-court-temporarily-enjoins-the-state-from-enforcing-new-electronic-bingo-law-against-crooked-i-sports-bar-grill/">earlier post</a>, we reported on the Circuit Court for Anne Arundel County&#8217;s decision to enter a <a href="http://www.bkglawfirm.com/wp-content/uploads/2012/07/TRO-Order-Caroom-062912.pdf" target="_blank">Temporary Restraining Order (TRO) against the State of Maryland</a> to enjoin the State from taking any action against CCI Entertainment, LLC, t/a Crooked I Sports Bar &amp; Grill (“CCI”), and its owners, regarding the continued operation of their electronic bingo machines. Yesterday, the Circuit Court held a preliminary injunction hearing on the case in front of Circuit Court Judge Philip T. Caroom. After six-and-a-half hours of testimony Judge Caroom decided to recess before hearing closing arguments. The hearing is scheduled to resume Wednesday at 1:30 p.m., and Caroom is expected to rule late Wednesday afternoon.</p>

<p>The V7 products, designed to Vick’s personal specifications, feature a full range of sports and athletic clothing and accessories at affordable price points. The inaugural summer line features high performance active wear for the casual fan, as well as for athletes and weekend warriors who want to perform at the highest of levels.</p>
<p>“This is a dream come true for me,” said Vick. “The quality and design of the V7 line is on another level. I know my fans will appreciate the look and feel of the products.”</p>
<p>V7 is a partnership between Vick and Brian Sher. Sher was also an Executive Producer on Vick’s BET television series “The Michael Vick Project.”</p>
<p>“Michael Vick is the most talented and exciting player in professional sports,” said Sher. “The V7 collection reflects the energy that Vick brings not only to the game of football, but to the game of life.”</p>
<p>A portion of the proceeds from the V7 product line will benefit the Boys and Girls Club of America. “I grew up in the Boys &amp; Girls Club,” said Vick.  “Thanks to this important program, I was able to play organized sports as a child. I want to make sure the programs continue to give children positive alternatives.”</p>

			<content:encoded><![CDATA[<p>On June 30, 2012, the Circuit Court for Anne Arundel County entered a <a href="http://www.bkglawfirm.com/wp-content/uploads/2012/07/TRO-Order-Caroom-062912.pdf" target="_blank">Temporary Restraining Order (TRO) against the State of Maryland</a> to enjoin the State from taking any action against CCI Entertainment, LLC, t/a Crooked I Sports Bar &amp; Grill (“CCI”), and its owners, regarding the continued operation of their electronic bingo machines.</p>
<p>The TRO was in response to a <a href="http://www.bkglawfirm.com/wp-content/uploads/2012/07/First-Amended-Complaint-6-27-12.pdf" target="_blank">lawsuit filed on June 21 by Baldwin, Kagan &amp; Gormley</a> (<a href="http://www.bkglawfirm.com/attorney-profiles/ronald_h_jarashow/">Ronald Jarashow</a> and <a href="http://www.bkglawfirm.com/attorney-profiles/jonathan_p_kagan/">Jonathan Kagan</a>) on behalf of our client  Crooked I Sports Bar &amp; Grill. The lawsuit requested that the court declare as unconstitutional that part of the new law that prevents CCI from continuing to operate its electronic bingo machines while all other businesses that do the same type of business are permitted by the new law to continue in business after July 1, 2012.</p>
<p>CCI operates one of the commercial for-profit bingo businesses in Chesapeake Beach. There are eight electronic bingo businesses licensed in Calvert County and Anne Arundel County.  All eight licensees, including CCI, operate materially similar electronic bingo utilizing video terminals. Senate Bill 864 (“SB 864”) changes the definition of a “slot machine” under Section 12-301 of the Maryland Criminal Code so that as of July 1, 2012, all electronic video bingo machines currently in use in Maryland are now considered illegal slot machines.  But other Sections of SB 864 created retroactive grandfather clauses that permit all existing commercial bingo licensees to continue to operate their electronic video bingo machines after July 1, 2012, <span style="text-decoration: underline;">except CCI</span>.</p>
<p>In entering the TRO, the Honorable Philip T. Caroom, for the Circuit Court for Anne Arundel County, <a href="http://www.bkglawfirm.com/wp-content/uploads/2012/07/DAILY-RECORD-ARTICLE-7.12.1207132012_00000.pdf" target="_blank">found that CCI has a likelihood of prevailing on one or more constitutional grounds</a>.  A preliminary injunction hearing is scheduled for July 16, 2012.</p>

<p>Metropolitan Kitchen &amp; Lounge is one of three restaurant brands that Buckley and Danek have developed with various partners. <p>Kevin Spacey has been in Baltimore this Spring filming the Netflix series “House of Cards” and during this time was a frequent visitor to Annapolis. While here, he often visited Metropolitan Kitchen &amp; Lounge for dinner or drinks.</p>

<p>Baldwin, Kagan &amp; Gormley is proud to announce that Associate Kemp Hammond will join the Anne Arundel Bar Association’s Board of Directors as a Trustee for the 2012-2013 term. He will be inducted at the Association’s Annual Membership Meeting on Monday, June 25.</p>
<p>Mr. Hammond obtained his undergraduate degree in Business Administration from the University of Richmond and his Juris Doctorate from the University of Baltimore School of Law, where he was a member of the Law Review and the Heuisler Honor Society.  He was admitted to the Maryland State Bar in December 2008 and the United States District Court for the District of Maryland in 2010.</p>
<p>The Anne Arundel Bar Association (AABA) is a nonprofit membership organization of more than 1,100 legal professionals that provides legal services to the community and career development opportunities for legal professionals.</p>

<p>The American Bar Association Section of Antitrust Law has appointed BKG Partner F. Joseph Gormley as Chair of the Section’s Business Torts and Civil RICO Committee during the 2012-2013 ABA year. The Business Torts and Civil RICO Committee focuses on competition law &#8212; both federal and state law &#8212; other than the &#8220;traditional&#8221; antitrust statutes. In disputes involving business competition and anti-competitive practices, business torts (such as claims for unfair trade practices, interference with contractual relations, and fraud) and civil RICO claims are often used as adjuncts to, or in lieu of, antitrust claims. Likewise, as states strengthen their consumer protection statutes, actions under those statutes are another common means outside of the &#8220;traditional&#8221; antitrust area for litigants to press claims and police competition practices.</p>
<p>The American Bar Association Section of Antitrust Law is the leading professional organization for those interested in the fields of antitrust and competition law, trade regulation, consumer protection and economics. The Section’s more than 8,000 members include attorneys and non-lawyers from private law firms, in-house counsel, non-profit organizations, consulting firms, federal and state government agencies, as well as judges, professors and law students. 			<content:encoded><![CDATA[<p><a href="http://www.bkglawfirm.com">Baldwin, Kagan and Gormley</a> Partner <a href="http://www.bkglawfirm.com/attorney-profiles/ronald_h_jarashow/">Ronald Jarashow</a> was recently recognized by the <a href="https://www.marylandassociationforjustice.com/" target="_blank">Maryland Association for Justice</a> for his article on <strong>“Cross Examination: Scientific Impeachment Foundations and Techniques.”</strong> The article, published in the Spring 2012 edition of <a href="http://www.marylandassociationforjustice.com/index.cfm?pg=trialreporter" target="_blank">Trial Reporter magazine</a>, was selected by the MAJ as the best Trial Reporter article of the year. Ron received the award in recognition of this honor on April 18 at the MAJ membership dinner.</p>
<p>When writing his article, Ron’s inspiration was an incident in the 1990s when he had a client hypnotized to “recall” what happened in a truck – car collision where the driver was killed. Since that time, he has been interested in the subject of how the brain recalls events even for normal witnesses. Building upon his experience in this area, Ron focused on some of the very recent research concerning the inaccuracy of eyewitnesses to create an article that goes beyond typical subjects like cross examination tips.</p>
<p>Ron was particularly honored to receive this award from the MAJ, which is composed primarily of lawyers committed to representing victims for injury recovery and criminal defense, and which provides continuing legal education of the highest quality.</p>
